Next Public Auction is:   October 20th at 2pm

1.  Bidder Requirements: To bid on a vehicle, you are required to register as a bidder/buyer. All bidders must be 18 years of age or older and present a valid Driver's License or government issued ID. A $200 refundable cash, check or credit card deposit is due to complete ALL registrations.  This contract is between the bidder and Billings Public Auto Auction (BPAA). The bidder shall be responsible for the bidder number assigned to this account.
2.  Vehicle Inspection: Bidder/Buyer is responsible, prior to the time of auction, for the inspection of the condition of any vehicle or item for which he bids. 
3.  As Is/Sale Guarantee: All vehicles are sold under two options, announced when vehicle is being auctioned:
   a. As Is: No Warranty Vehicles are sold with no guarantee and cannot be rejected for any reason.    
   b. Sale Guarantee means: i. the motor doesn't knock                          
                                               ii. the transmission shifts through all gears without slipping
                                               iii. the four wheel drive works.   
Sale Guarantee up to until 5:00pm sale day Friday.  BPAA representatives will make the final decision regarding Sale Guarantee issues.  After 5:00 pm vehicle is an AsIs vehicle.
4.   Contract to Purchase: By bidding on a vehicle or item either verbally or in writing, the bidder is entering into a contract of purchase at the Auctioneer's offered price. The final bid becomes an oral contract that is legally binding when the auction representative says "SOLD". The highest bidder is considered the Buyer and will be responsible, under contract, for payment of the Property and all associated fees. The Auction service reserves the right to reject or void bids at any time for any reason and is the single deciding authority with sole and absolute discretion in resolving disputes.  
5.   Bidder/Buyer Fees: Buyer's fees, as posted below, will be added to the contract purchase price.

6.   Payment:  Payment due on auction sale day.  Unless arranged prior to the auction, payment shall be by Cash, Credit Card, Certified Funds or check with Bank Letter of Credit, or signed Check Approval Agreement. All monies owed to the Auction, including purchase price and associated fees, must be paid before the property is released to the buyer. If a buyer does not pay in full for any item for which an offer was made and accepted, the buyer will be held responsible to Billings Public Auto Auction for all expenses and lost fees associated with failure to pay.
7.   Credit Card Purchases: Every credit or debit card sale will be charged a 3% funds processing fee which is added to the total due which includes sale price, buy fees and doc fees.
8.   Insurance/Loss: From the time of purchase, the buyer recognizes and acknowledges hereby that he assumes full responsibility and liability for any damage that may be done to or by the property until and following the time when the property is removed from the BPAA lot and hereby indemnifies BPAA from and against any loss, damage, claim or legal proceeding arising out of or in connection with damage to or caused by the property. The buyer hereby releases BPAA from any damage resulting in theft, loss or accident to the property. 
9.   Title Transfer: Upon payment for the vehicle, a Temporary Registration Permit will be provided. Within 40 days from date of purchase, a clear (meaning a title that has not been branded as "salvaged", "restored", "rebuilt", "repaired", or similar term, or otherwise altered, unless otherwise announced at the time of the auction) and marketable title will be mailed to the buyer of the vehicle. Register and acquire license plate at the county office of the address issued on the TRP. In limited cases, a title may be delayed. In the event that there is a problem with the title or it cannot be produced within 45 days, the buyer can return the property and the sale price will be refunded.
10.   Vehicle Release: Paid in full vehicles must be picked up on auction sale day unless other arrangements have been made. Auction service is not responsible for security for vehicles left on the BPAA lot.
11.   Resale: BPAA reserves the right to resell any property not paid for in full within 7 days of the initial sale of the property. The original buyer shall be responsible to BPAA for any expenses incurred in collection costs, the resale, and any damages or shortages resulting from the resale. If, for any reason, a vehicle is returned by the buyer, the buyer will be responsible for any damage, wear and tear and miles driven. Miles and repairs are to be charged at legal and market rates at the discretion of Auction service.
